Development and planning
Under the Water and Sewerage Industry Act 2008 Ben Lomond Water is responsible for the provision of referral advice to the Planning Authority (including councils) on water and sewerage matters.
When an applicant submits a Planning Application to the planning authority the planning authority must refer water and sewerage related applications to Ben Lomond Water. The planning authority use a Referral to Regulated Entity questionnaire or check-list to determine which application must be referred.
On receipt of a referred application Ben Lomond Water has 14 days (assessment period) to:
- Refuse
- Consent with no conditions
- Consent with conditions
Ben Lomond Water may, within 7 days of receipt of the application, request further information as required to assess the application. Where further information is sought, the 14 day assessment period stops. The assessment period recommences when satisfactory information is received by Ben Lomond Water.
